3. Scope of Services

Jepsen Global provides professional immigration consulting services for both the United States and Canada. We assist with application preparation, document gathering, form completion, submission to relevant authorities, and ongoing case management. We do not guarantee approval of any visa, green card, permit, or application. All immigration decisions are made solely by government authorities including USCIS, IRCC, US consulates, visa offices, and immigration tribunals.

Our consultants provide advice based on current immigration laws and policies of both countries. Immigration laws change frequently, and we cannot be held responsible for changes that occur after we provide our advice or submit your application.

Important Note: Jepsen Global is strictly an immigration consulting firm. We are not a job recruitment agency, employment placement agency, or staffing firm for either the United States or Canada. We do not find jobs for clients, guarantee employment in either country, or match candidates with employers. Our services focus solely on immigration applications and pathways. Any employment obtained in the US or Canada is the sole responsibility of the client and independent of our services.

4. Client Responsibilities

As a client, you agree to:

  • Provide complete, accurate, and truthful information and documentation

  • Disclose all relevant facts that may affect your application, including criminal history, previous refusals, medical conditions, immigration violations, and misrepresentation issues

  • Respond promptly to our requests for information, documents, or signatures

  • Pay all fees as outlined in your service agreement

  • Notify us immediately of any changes to your contact information, circumstances, or immigration status

  • Understand that providing false or misleading information may result in application refusal, bans from the US or Canada, deportation, or criminal prosecution

Failure to meet these responsibilities may result in delays, refusal of your application, or termination of our services without refund.

We provide strategic advice on these pathways but do not guarantee outcomes. All Canadian immigration decisions are made solely by IRCC and immigration officers.

7. No Guarantee of Results

Jepsen Global does not guarantee the approval of any application for either the United States or Canada. Immigration officers in both countries have complete discretion to approve or refuse applications based on their assessment of your eligibility, credibility, and compliance with immigration laws.

Factors outside our control include but are not limited to: processing times, policy changes, quota limitations, visa bulletin backlogs, officer discretion, background checks, medical inadmissibility, criminal inadmissibility, public charge determinations, and misrepresentation findings.

Our success rate is based on past performance and does not predict future results. Each application is unique and assessed on its own merits.

8. No Employment Guarantee or Job Placement

Jepsen Global is an immigration consulting firm only, serving both the US and Canadian markets. We do not operate as a job recruitment agency, employment placement service, or staffing firm in either country. We do not:

  • Guarantee or promise job placement in the United States or Canada

  • Find employment opportunities for clients in either country

  • Match candidates with specific employers

  • Arrange job interviews or job offers

  • Provide Labor Condition Applications (LCA) for H-1B visas or Labour Market Impact Assessments (LMIA) for Canada beyond immigration advice

  • Charge fees for job placement, which is strictly prohibited by law in both countries

Any claims or suggestions that we provide job placement services are false. If you encounter any third-party making such claims on our behalf, please report it to us immediately.

Clients who secure job offers do so independently through their own efforts, networking, or legitimate job search platforms. We may provide general advice on how job offers can impact immigration applications for either country, but we do not facilitate the job search process.

9. Fees and Payment

All fees for our services are outlined in your signed service agreement. Fees are quoted in the currency specified and do not include government filing fees (USCIS, IRCC, or DOS fees), third-party fees (such as language tests, educational credential assessments, medical exams, police certificates, biometrics fees), or applicable taxes.

Government fees are subject to change without notice. You are responsible for paying all government fees directly or reimbursing us if we pay on your behalf.

Payment terms are specified in your service agreement. Late payments may result in suspension of services. Refunds are governed by the refund policy in your service agreement and applicable consumer protection laws.

10. Confidentiality and Privacy

We take your privacy seriously. All information you provide is protected under applicable privacy laws. We do not share your personal information with third parties except:

  • As required to process your application (USCIS, IRCC, Department of State, consulates, designated organizations)

  • As required by law or court order

  • To protect our legal rights or prevent fraud

Your information is stored securely and retained only as long as necessary for legal and business purposes. You may request access to your file at any time.

11. Limitation of Liability

To the maximum extent permitted by law, Jepsen Global shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, opportunities, or anticipated savings

  • Damages resulting from application refusals, delays, or government decisions from either the US or Canada

  • Actions taken by immigration authorities or third parties in either country

  • Any outcomes related to employment search or job placement, as we do not provide such services

Our total liability to you for any claim arising from our services shall not exceed the total fees you paid to us in the twelve months preceding the claim.

Nothing in these terms excludes liability for fraud, death, personal injury, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Jepsen Global, its employees, consultants, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

13. Termination of Services

Either party may terminate the service agreement in accordance with its terms. We may terminate services immediately if:

  • You provide false or misleading information

  • You fail to pay fees when due

  • You act in a manner that damages our reputation or business

  • We reasonably believe continuing services would violate immigration laws or professional ethics of either country

Upon termination, we will provide you with all original documents in our possession. Digital files may be retained as required by law.

14. Intellectual Property

16. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or our services shall be resolved in the courts of Ontario, Canada. For US clients, this choice of law applies to the contractual relationship, but immigration matters are governed by US federal law.

17. Dispute Resolution

We encourage you to contact us first to resolve any concerns. If a dispute cannot be resolved informally, you agree to submit to binding arbitration in accordance with the rules of the ADR Institute of Canada before pursuing litigation.

The arbitration shall take place in Toronto, Ontario, in English. The arbitrator's decision shall be final and binding.

18. Force Majeure

We shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions including shutdowns, war, terrorism, strikes, internet outages, or changes in immigration laws of either the United States or Canada.

19. Amendments to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

Material changes will be communicated to active clients via email.

20. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms and Conditions, together with your signed service agreement, constitute the entire agreement between you and Jepsen Global. They supersede all prior agreements, representations, or understandings, whether written or oral.
